Withdrawal of S173 Notice to Terminate Periodic Occupation Contract RHW19

This Withdrawal of S173 Notice RHW19 is prescribed by the Welsh Government. The form should be used by private residential landlords within 28 days of serving a S173 the Renting Homes (Wales) Act 2016 Notice (Form RHW16) when:

  • there is an error in the original S173 Notice (Form RHW16). The effect of serving Form RHW19 is to immediately withdraw the original s173 notice and a replacement S173 Notice (RHW16) can be issued without needing to wait six months; or
  • the landlord no longer wishes the contract-holder to leave the dwelling. The contract-holder can object in writing to the withdrawal of the notice at which point the original S173 Notice will remain in place. If the withdrawal is accepted, the landlord will be unable to issue a further s173 Notice (RHW16) for six months.
