Withdrawal of S173 Notice to Terminate Periodic Occupation Contract RHW19

This Withdrawal of S173 Notice RHW19 is prescribed by the Welsh Government. A landlord uses it to withdraw a notice given under section 173 of the Renting Homes (Wales) Act 2016 (Form RHW16) at any time before the contract ends. The effect depends on when it is given:

• if it is given within 28 days starting with the day the section 173 notice was given, the notice is withdrawn when the RHW19 is given and the contract-holder cannot object. The landlord may then give one more section 173 notice (for example, to correct an error in the original RHW16), but only within that same 28-day period; or
• if it is given after that 28-day period, the notice is withdrawn only if the contract-holder does not object in writing before the end of a reasonable period. If the contract-holder objects in time, the original section 173 notice remains in place. Once a notice is withdrawn, the landlord cannot give another section 173 notice for six months starting with the day of the withdrawal, except the one further notice allowed within the first 28 days.
