Statutory Notice Regarding Ceasing to be a PSC (individual)

This Statutory Notice regarding ceasing to be a PSC, relates to the circumstances where a company knows (or has reasonable cause to believe) that an individual has ceased to be a registrable person in respect of a company (section 790EA Companies Act 2006) but has not had confirmation that the person has ceased to be a registrable PSC or has not had confirmation of the date on which this occurred.

Companies must only send confirmed information to Companies House and have a duty to keep information about their PSCs up to date and find out about any changes in PSC information, including that a PSC has ceased to be registrable. Therefore if a company knows (or has reasonable cause to believe) that a PSC has ceased to be registrable, the company must take reasonable steps to verify this. 

This letter gives notice to the PSC to confirm their current status in respect of the company as well as state their current details and registrable interest, if any, within one month of the date of the letter.

The company must give the notice as soon as reasonably practicable after the company becomes subject to the duty to give a notice (i.e. when the company becomes aware of the potential cessation) and in any event before the end of the period of 14 days beginning with the day on which the company becomes subject to the duty under section 790EA of the Companies Act 2006.
