Statutory Notice to Those with Knowledge of PSCs

CO.PSC.04

This Statutory Notice to Those with Knowledge of PSCs is the type of notice that a company may give to an individual under section 790D of the Companies Act 2006, where the addressee is not a PSC but the Company knows (or has reasonable cause to believe) that the individual may have knowledge of someone who is a registrable person.

Companies must only put confirmed information on their PSC register and therefore they must take reasonable steps to find out if there is anyone who is a PSC/RLE and identify them and their registrable interest. If a company knows or has reasonable cause to believe that a person either knows the identity of someone that is registrable or, knows the identity of someone likely to have that knowledge, they may send a notice to them asking them to confirm their knowledge.

This letter gives notice to the relevant individual to confirm their knowledge within one month of the date of the letter.

A form of this notice is also freely available from the www.gov.uk website.
