This letter is intended to be sent by the transferee to the transferor informing it of any measures that the transferee envisages taking following a transfer under the Transfer of Undertakings (Protection of Employment) Regulations 2006.
In a TUPE transfer, both the transferee and transferor are required to provide certain information to appropriate representatives of any of their employees who will be affected by the transfer. This includes, in the case of the transferor, any measures that the transferee envisages that it will take in respect of the transferring employees in relation to the transfer. If the transferee does not envisage taking any measures, the transferee must advise the transferor of that fact.
In the context of TUPE, ‘measures’ is taken to mean actions or arrangements taken in connection with the transfer.
