Terms and Conditions for Airbnb Agency (Management Only)
These Terms and Conditions for Airbnb Agency (Management Only) are for use by agencies specialising in the management of short-term lets that the Owner has arranged through Airbnb or similar websites.
The terms and conditions set out the Agency’s duties and provides for a fee to be paid by the Owner. The terms and conditions, together with the Airbnb Agency Appointment Form, create a contract between the Agency and the Owner.
This version of the terms and conditions should be used where the Owner handles bookings but the Agency takes responsibility for the property during the letting period (handover of keys, cleaning, etc.). If the Agency is to provide a full booking and management service, the Terms and Conditions for Airbnb Agency (Book and Manage) should be used instead.
Clause 1 contains definitions and in some cases refers to information contained in the Airbnb Agency Appointment Form.
Clause 2 covers the appointment of the Agent.
Clause 3 sets out the duties of the Agent. These include handing over keys to guests, cleaning and inspecting the property.
Clause 4 sets out the rights and duties of the Owner. It requires the Owner to handle bookings, furnish the property and provide bed linen, towels and toiletries.
Clause 5 covers payment of the Agent’s fees.
Clauses 6 and 7 deal with extension and termination of the contract between the Agent and the Owner. Either party may extend or terminate the contract by giving a specified period of notice to the other. The contract can also be terminated on the grounds of insolvency.
Clauses 8 to 11 contain standard legal interpretation wording and provisions regarding the service of notices.
