Data Sharing Agreement
Business share all kinds of data for all kinds of reasons. When that data is personal data, however, additional care is required. In some cases, a data controller will share data with another data controller (as opposed to delegating the processing of it to a data processor).
Using a Data Sharing Agreement, a data controller (that is, a party who determines what is to be done with the personal data in question, rather than taking instructions from another party) is able to share personal data for certain agreed purposes with another data controller. The third party controller is not under the instruction of the first controller; but the agreement does impose a number of restrictions upon their use of the shared data, along with a series of obligations designed to ensure that both parties comply with their obligations under the UK GDPR and the Data Protection Act 2018.
