This Sales Manager Employment Contract with Car and PILON is intended for use for Sales Managers with management responsibility for a particular sales territory where a car/car allowance is part of the benefits package. For a Sales Representative, see the Sales Representative Employment Contract in this folder. Within this folder, there is also a Sales Manager Employment Contract for use where cars/car allowance are NOT offered by the Employer and a Sales Manager Employment Contract which makes more detailed reference to the Employer’s commission and bonus structures.

This contract has been recently updated to include new and improved clauses providing enhanced protection for the employer.

The Sales Manager Employment Contract with Car and PILON contains an optional clause in respect of bribery, to assist you in complying with your obligations in line with the Bribery Act 2010.

This Sales Manager Employment Contract with Car and PILON includes employee covenants in respect of confidentiality, exclusivity of service, restrictive covenants and garden leave. These covenants are designed to protect the Employer’s legitimate business interests, for example, client contacts.

In addition, the Sales Manager Employment Contract with Car and PILON includes clauses relating to company cars or car allowance (and a reference to the Employer’s own company car policy) and the provision of a laptop and company credit card. This Employment Contract includes a payment in lieu of notice (a ‘PILON’) on termination, rather than having the Manager work out his or her notice period either at home on garden leave or in the workplace. The payment in lieu clause enables the Employer to require the Manager not to work during his notice period, whilst retaining the validity of employee covenants. However, the clause prevents such PILON payments being made "tax free" and prevents the negotiating benefits that brings.
