Retail Assistant Employment Contract
This Retail Assistant Employment Contract is appropriate for a permanent shop assistant role. When hiring a shop assistant on a temporary or fixed term basis please use the Retail Assistant Fixed Term Employment Contract.
This Employment Contract covers the requirements of a Standard Form Section One Statement. This contract complies with these requirements and must be provided to the employee or worker by day one of employment.
This contract includes clauses which have been specially tailored to a retail environment. For example, there is reference to a staff rota, working outside normal retail opening hours to assist in preparation and closure of the business, and appropriate rest breaks.
There is an optional clause where the employee authorises the Company to deduct up to 10% of their gross monthly salary to cover shortfalls in stock or till takings, as long as the employee has been notified of their liability for this shortfall before making the deduction.
This shop assistant employment contract also contains an optional clause entitling the employee to participate in the company commission or bonus scheme.

This Retail Assistant Employment Contract is compliant with the Employment Rights Act 1996, the Employment Act 2002 and the Working Time Regulations 1998.
The Pension Act 2014 has introduced a new state pension for people reaching state pension age on or after 6 April 2016, replacing the previous basic state pension and additional state pension and ending contracting out for defined-benefit schemes. This template has been updated accordingly with the removal of the clause referring to the contracting out certificate.
