Website Terms of Sale - Online Personal Fitness Training (B2C)

BS.WEB.TCZ.04

These Website Terms of Sale - Online Personal Fitness Training (B2C) are designed for personal fitness trainers and training providers offering online fitness and wellness training to clients on a subscription basis.

They cover access to live or recorded online sessions together with downloadable supporting materials, with the scope of the training set out in an attachment to the main terms.

Use these terms for subscription-based online fitness training

The template is suitable for a wide range of fitness and wellness services. Depending on what is offered, this can include assessment and testing, physical training, aerobic and cardiovascular exercise, resistance and weight training, use of equipment, goal setting, exercise programmes, nutrition advice, weight loss support, muscle toning, strength building, and general motivation and instruction.

It can be used whether the trainer is a sole trader contracting personally with the client or a company or partnership providing the training through an engaged trainer. In each case, the client contracts as a consumer.

Covers different session formats

The subscription can cover single or multiple video sessions together with accompanying downloadable materials. The template is broad enough to support different methods of delivery, including:

  • Live one-to-one two-way sessions
  • Pre-recorded on-demand training sessions
  • Live one-way streamed sessions
  • Live interactive group classes

Each subscription can provide access to a specific live session date or to a stated access period for pre-recorded content, with the relevant details set out on the website and confirmed in the client’s order details.

Designed for online-only provision

These terms assume that everything sold under them is provided online only. They are not suitable where training takes place in person or where physical items such as books, paper materials, CDs, or DVDs are supplied.

The template also assumes that the client must create an account before purchasing any sessions, although doing so does not commit them to a purchase.

Includes platform-specific, health-related, and consumer law provisions

An attachment to the main terms deals with the practical delivery of online training using a cloud-based web conferencing platform such as Zoom. Most of the provisions specific to online delivery sit in that attachment, including technology requirements, equipment, account security, privacy, fitness, health and safety, and the client’s responsibility to provide health-related information.

The main terms cover the order process, contract formation, pricing, payment, provision of paid content, licensing, complaints, liability, contact information, and data protection.

Particular care should be taken over how paid content is described on the website and in the terms, especially in relation to what is included in the subscription.

Cancellation rights are addressed in detail, including the 14-day cooling-off period granted to consumers under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

This template applies only to the sale of content, leaving the terms governing use of the website itself to a separate document.
