Website Terms of Sale - Online Tuition (Minors) (B2C)
These Website Terms of Sale - Online Tuition (Minors) (B2C) are designed for tutors and teaching providers offering online tuition to minors, where the contract is made with the student’s parent or guardian as the consumer.
They cover subscription-based access to live or recorded video lessons together with downloadable supporting materials, all provided online through a website.
Use these terms where a parent or guardian buys online tuition for a child
Because the student is under 18, the agreement is between the tutor and the parent or guardian, not the student. The template also includes provisions that reflect the fact that the tuition is being provided to a minor.
It is suitable for a wide range of school subjects commonly taught in the UK. It is not intended for teaching a musical instrument, for which the separate Website Terms of Sale - Online Music Teaching (B2C) should be used.
Covers different online lesson formats
The subscription can cover single or multiple video lessons together with accompanying downloadable materials. The template is flexible enough to support different styles of online teaching, including:
- Live one-to-one two-way lessons
- Pre-recorded on-demand lessons
- Live one-way streamed lessons
- Live interactive group classes
Each subscription can provide access to a specific live lesson date or to a stated access period for pre-recorded content, with the relevant details set out on the website and confirmed in the parent or guardian’s order details.
Designed for online-only provision
These terms assume that all tuition is provided online only. They are not suitable where teaching takes place in person or where physical items such as books, CDs, or DVDs are supplied.
The template also assumes that the parent or guardian must create an account before purchasing lessons, although doing so does not commit them to a purchase.
Includes platform-specific and consumer law provisions
An attachment to the main terms sets out the detailed teaching arrangements, including use of a cloud-based web conferencing platform such as Zoom. Most of the provisions specific to online delivery sit in that attachment, including technology requirements, account security, privacy, health and safety, and teaching-related matters such as professional references and DBS wording where relevant.
The main terms cover the order process, contract formation, pricing, payment, provision of paid content, licensing, complaints, liability, contact information, and data protection.
Particular care should be taken over how paid content is described on the website and in the terms, especially in relation to what is included in the subscription.
Cancellation rights are addressed in detail, including the 14-day cooling-off period granted to consumers under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
This template applies only to the sale of content, leaving the terms governing use of the website itself to a separate document.
