Website Terms of Sale - Online Counselling or Therapy (B2C)

BS.WEB.TCZ.12

These Website Terms of Sale - Online Counselling or Therapy (B2C) are designed for professionals providing counselling or therapy services to adult consumers on a subscription basis.

They cover access to live or recorded online sessions together with downloadable or viewable supporting materials, all delivered remotely through a website.

Use these terms for subscription-based online counselling or therapy

The template is suitable for a wide range of counselling and therapy services that can be provided remotely. It is intended for services delivered by speech or by using text, graphics, or video shared with the client, rather than physical or medical therapy.

It can be used by psychologists, psychotherapists, bereavement, relationship, rehabilitation, education, substance abuse, or mental health counsellors, behaviour or brief therapists, and other similar professionals. An attachment to the main terms can be adapted to reflect the particular type of practitioner and service offered.

Covers personal sessions and one-way content

The subscription can cover single or multiple video sessions together with accompanying downloadable or viewable materials. The template supports:

  • Live private one-to-one two-way counselling or therapy sessions
  • Pre-recorded information or guidance sessions available on demand
  • Live one-way streamed sessions that may also be recorded for later access

Live one-to-one sessions are intended to be personal to the individual client in the same way as an in-person session.

Each subscription can provide access to a specific live session date or to a stated access period for pre-recorded content, with the relevant details set out on the website and confirmed in the client’s order details.

Designed for online-only provision

These terms assume that everything sold under them is provided online only. They are not intended for the supply of physical items such as books, paper materials, CDs, or DVDs.

The template also assumes that the client must create an account before purchasing any sessions, although doing so does not commit them to a purchase.

Includes platform-specific, wellbeing, privacy, and consumer law provisions

An attachment to the main terms deals with the use of a cloud-based web conferencing platform such as Zoom. Most of the provisions specific to online delivery sit in that attachment, including technology requirements, account security, privacy in two-way sessions, wellbeing, health and safety, the scope of the content, and the client’s commitment.

The main terms cover the order process, contract formation, pricing, payment, provision of paid content, licensing, complaints, liability, contact information, and data protection.

Particular care should be taken over how paid content is described on the website and in the terms, especially in relation to what is included in the subscription.

Cancellation rights are addressed in detail, including the 14-day cooling-off period granted to consumers under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

This template applies only to the sale of content, leaving the terms governing the use of the website itself to a separate document.
