These Website Terms of Sale - Online Architect’s Services (B2C) are designed for architects and architect practices providing online consultations and related content to consumer clients on a subscription basis.

They can be used for one-to-one live consultations about a client’s proposed project, as well as recorded information sessions, downloadable materials, and other online services described in an attachment to the main terms.

Use these terms for subscription-based online architect services

The template is suitable for architect practices offering online services to consumers, whether the architect is a sole trader contracting personally with the client or a company or partnership providing the services through one or more engaged architects.

An attachment to the main terms sets out what is actually provided or made available and can be adapted to reflect the way each practice delivers its online service.

Covers live consultations, recorded content, and group sessions

The subscription can cover single or multiple sessions together with accompanying downloadable materials. The template supports:

  • Live one-to-one two-way consultation sessions
  • Pre-recorded information sessions available on demand
  • Live one-way information sessions
  • Live interactive group sessions and webinars

In a live consultation, the architect and client can see and speak to each other, and the architect can share drawings or other material on screen where needed.

Each subscription can provide access to a live session on a specific date or to pre-recorded content during a stated access period, with the relevant details set out on the website and confirmed in the client’s order details.

Designed for online-only provision

These terms assume that everything sold under them is provided online only. They are not suitable for in-person consultations or for the supply of physical items such as books, paper materials, CDs, or DVDs.

The template also assumes that the client must create an account before purchasing any sessions, although doing so does not commit them to a purchase.

Includes platform-specific and consumer law provisions

An attachment to the main terms deals with the use of a cloud-based web conferencing platform such as Zoom. Most of the provisions specific to online delivery sit in that attachment, including technology requirements, account security, privacy, communication requirements, the client’s brief, the architect’s content, and the result of a consultation.

The main terms cover the order process, contract formation, pricing, payment, provision of paid content, licensing, complaints, liability, contact information, and data protection.

Particular care should be taken over how paid content is described on the website and in the terms, especially in relation to what is included in the subscription.

Cancellation rights are addressed in detail, including the 14-day cooling-off period granted to consumers under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

This template applies only to the sale of online content, leaving the terms governing the use of the website itself to a separate document.
