This Letter - 14 Days’ Notice of Court Proceedings to Recover Debt should be used if a creditor intends to take court proceedings against a debtor.

This letter complies with the Pre-Action Protocol for Debt Claims which applies where the debtor is an individual (including a sole trader). It is not essential to use this letter in cases where the Protocol does not apply, although the creditor may wish to do so to give the debtor a final chance to resolve the matter before the court becomes involved.

Before this letter is sent, the creditor must have sent a Letter of Claim and, if the Protocol applies, must have complied with the requirements of the Protocol such as providing information to the debtor and attempting to resolve the matter between the parties.

The letter refers to the Letter of Claim and subsequent correspondence and states the creditor’s intention to start court proceedings. It confirms that, in line with the Protocol, court proceedings will not be started less than 14 days from the date of the letter.
