These E-Commerce Sale of Goods Website Terms of Sale for Food Products are designed for use by online retailers on e-commerce
websites providing goods to consumers. These terms are sufficiently broad
to cover a wide range of food products and include terms dealing with
alcohol content (age restrictions) and allergen information.
This document is designed for use alongside our E-Commerce Sale of Goods
website, while this Terms of Sale template covers the sale and purchase of
goods. It is important to ensure that both documents are used together.
This document has been updated, removing an optional provision allowing the
seller to restrict the sale of goods to UK customers only. This change has
been made to improve compatibility with the 2018 EU Geo-Blocking
Regulation, which takes effect on 3 December 2018.
It is important to note, however, that this document remains intended for
UK use. Specific laws that may apply in other EU member states are not
addressed and it is important to ensure that you are fully aware of, and in
compliance with, such laws if you specifically direct your activities
toward any particular member state.
Due to the perishable nature of food products, these Terms of Sale
expressly exclude the 14-day cooling off period normally granted to
consumers by the 2013 Consumer Contracts Regulations. Customers are given a
very limited right to change their mind and cancel before an order is
dispatched. Provisions are also included which cover customers’ remedies in
the event of a problem with the food products.
Using consumer-friendly language, these e-commerce terms of sale guide
customers through the order process, explaining the formation of the
contract between them and the retailer, also setting out details on goods,
pricing and availability (with particular regard for the accuracy of, and
changes to such information), payment, delivery, risk and ownership.
Further key provisions deal with liability, events beyond the retailer’s
control, customer complaints (with reference to complaints handling
policies and procedures, templates for which are also available from
Simply-Docs), contact information, and data protection.

read carefully and selected so as to be compatible with one another. Unused
