Letter Refusing Request for Carer's Leave
Carer’s leave gives employees the right to take up to one week’s unpaid leave in a rolling 12-month period to provide care or assist someone who is dependent on them and who has a long-term care need. This is a right that applies from day one of employment.
An employer cannot refuse a request for carer’s leave unless it is for the reasons stated in this letter, i.e. because:
- The employee has already exhausted their eligibility for carer’s leave; or
- The employee does not meet the eligibility requirements for carer’s leave.
Employers can postpone a request for carer’s leave if it would cause ‘undue disruption’ to the business. If carer’s leave is postponed, a new date for carer’s leave must be agreed within a month of the original request. There is a separate letter covering postponement of carer’s leave.
