The employee, whether the mother or the partner, must provide his or her employer with a non-binding Notice of Entitlement and Intention to take SPL. This is the form to be used by the mother. Please see also the separate Notice of Entitlement and Intention to take Shared Parental Leave (Mother
The partner's notice of entitlement and intention, which must be in writing and provided at least eight weeks before the start date of the first period of shared parental leave to be taken by the employee, must set out:
- the father's name;
- the mother's name;
- the start and end dates of any statutory maternity leave taken or to be taken by the mother;
- the total amount of shared parental leave available;
- the child's expected week of birth and the child's date of birth; how much shared parental leave the mother and partner each
intend to take; and - a non-binding indication as to when the employee intends to take shared parental leave (including start and end dates for each period of leave).
The partner's notice of entitlement and intention must include a signed declaration stating that:
- the partner satisfies, or will satisfy, the eligibility requirements to take shared parental leave;
- the information given in the notice of entitlement and intention is accurate; and
- the partner will immediately inform the Company if they cease to care for the child or if the mother revokes the curtailment of her maternity leave or pay period.
