Guidance on repair and The Renting Homes (Fitness for Human Habitation) (Wales) Regulations 2022


When the Renting Homes (Wales) Act 2016 comes into force on the 15 July 2022, new repair and fitness for human habitation obligations will apply for landlords, and letting agents (acting on their behalf, in Wales. It is important that landlords and letting agents understand these obligations and are prepared for these changes when they come into force.

This Guidance Note on repair and The Renting Homes (Fitness for Human Habitation) (Wales) Regulations 2022 explains the obligations on private residential landlords and letting agents (acting on their behalf) in Wales, to ensure their dwellings are in repair and fit for human habitation throughout the occupation contract. It also looks at the limits on the landlord’s obligations and the consequences of breach.

There are a number of consequences if a landlord (or agent) fails to comply with these obligations. A contract-holder can withhold rent, a court could make an order for specific performance and a landlord could also lose its licence under Rent Smart Wales. A landlord may also not be able to serve a possession notice if they are in breach of the regulations.

This Guidance may be reviewed and updated (if necessary) in line with any supplementary legislation or supporting guidance which may be published by the Welsh Government.
