Deed of Release of Guarantor
This Deed of Release of Guarantor can be used to release a Student Tenant’s Guarantor from a Tenancy Agreement Guarantee.
The Landlord may have required a parent to stand as Guarantor for a Tenant when the Tenancy Agreement was entered into. If the Tenancy Agreement is assigned to a new Tenant, the outgoing Tenant’s Guarantor should be released from the Guarantee.
Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so as to be compatible with one another. Unused options should be removed from the document.
Under the Tenant Fees Act 2019, landlords in England cannot charge a tenant more than £50 (inclusive of VAT) for agreeing to alter tenancy agreements caught by this act. In some circumstances it may be appropriate for this to be higher but such cost must be reasonable and a landlord must be able to provide written evidence (invoices/receipts) which show that these costs are reasonable.
Under the Renting Homes (Fees etc.) (Wales) Act 2019, landlords and/or letting agents in Wales are prohibited from charging a fee to amend an assured shorthold tenancy agreement.
This Deed of Release of Guarantor is in open format. Either enter the requisite details in the highlighted fields or adjust the wording to suit your purposes.
