In effect since 1 June 2019, the Act applies exclusively to England and aims to reduce “hidden” costs for tenants at the beginning of their tenancy. Landlords and lettings agents cannot require tenants to make certain payments in connection with a tenancy, except for those expressly permitted under Schedule 1 of the Act.
Failure to comply with the legislation will result in fine of up to £5,000. A repeat breach within a period of five years becomes a criminal offence, carrying an unlimited fine and a potential banning order. Enforcement authorities may impose a fine of up to £30,000 instead of prosecution. Additionally, failure to repay a holding deposit can result in a fine of up to £5,000.
