Gas and Electrical Safety Compliance Letters and Templates for Residential Landlords

Landlords managing residential tenancies in England have a legal duty to ensure their rental properties are safe and compliant with current gas and electrical safety regulations. Failure to meet these statutory requirements can result in substantial fines, civil claims, or even criminal prosecution. 

Gas Safety For Landlords 

Under the Gas Safety (Installation and Use) Regulations 1988, and the Gas Safety (Management) (Amendment) Regulations 2023, landlords must ensure that all gas appliances, fittings and flues within the rental property are inspected annually by a competent person. 

Landlords are required to:

  • Provide tenants with a Gas Safety Certificate within 28 days of inspection; or
  • supply the certificate before the tenancy begins for new tenants

Failure to comply with these regulations can result in prosecution by the Health and Safety Executive and may also impact the landlord's ability to regain possession of their property if the certificate has not been provided.

Electrical Safety For Landlords

Under the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020, landlords must ensure that the electrical installation in the property is inspected and tested by a qualified electrician at least every five years.  

Landlords must:

  • Provide tenants with a copy of the Electrical Installation Condition Report (EICR) within 28 days of the inspection, or before the tenancy begins;
  • supply a copy to the local authority if requested. 

To assist with compliance, landlords can use the Letter EIR to Proposed Tenant (England) to confirm compliance and provide an EICR prior to the start of the tenancy. Letter EIR to Residential Tenant (England) can be used by landlords when an EICR has been carried out during the tenancy. 

New Regulations Extending To Social Landlords and Rules Affecting Private Landlords

From 1 November 2025, The Electrical Safety Standards in the Private Rented Sector (England) (Amendment) (Extension to the Social Rented Sector) Regulations 2025 will come into force. These will extend the existing 2020 regulations to registered providers of social housing. 

There will be a phased implementation of the regulations as follows:

  • From 1 November 2025: All new social housing tenancies must comply with the five-year-inspection and reporting requirements;
  • By May 2026: existing tenancies must also be brought into compliance. 

Social landlords will be required to provide tenants and local authorities with EICRs in the same way as private landlords. 

Landlords will have a defence against prosecution if they can demonstrate they took all reasonable steps to comply with their electrical safety duties. Where a tenant ( or someone acting for them) refuses access for the inspection or repair, landlords will  not be required to commence legal proceedings to establish this defence. 

Under the new regulations, local authorities will have enhanced powers,  including issuing remedial notices for non-compliant properties. More importantly, financial penalties for breaches will increase from  £30,000 to £40,000.
