Variation Agreement
This Variation Agreement should be used when the Landlord and Tenant have agreed to permanently change one or more terms of a residential tenancy agreement in England.
If the proposed change is intended to apply only temporarily, the Letter Waiving a Provision of the Tenancy Agreement should be used instead.
What Is This Template Used For
The Variation Agreement allows the parties to:
- Delete a clause of the tenancy agreement
- Add a new clause; and/or
- Amend the wording of an existing clause
Renters' Rights Act
Under the new legislation, fixed term tenancies will be abolished from 1 May 2026, and all residential tenancies will become assured periodic tenancies. As a result no changes can be made to the tenancy in relation to the term.
The Tenant Fees Act 2019
Under the Tenant Fees Act 2019 (England):
- Landlords can require a fee to change the tenancy when requested by the tenant capped at no more than £50 (inclusive of VAT),
- If the actual costs of making the changes exceed £50, a landlord may recover reasonable costs, provided they can supply written evidence (e.g. invoices or receipts) to justify the amount.
