Variation Agreement

This Variation Agreement is used where a landlord and tenant have agreed to change change, amend, or remove a clause in the original residential tenancy agreement in England. If the change is intended to apply only temporarily, use the Letter Waiving a Provision of the Tenancy Agreement instead.

What this Variation Agreement covers

The agreement allows the parties to:

• delete a clause of the tenancy agreement;
• add a new clause; and/or
• amend the wording of an existing clause.

Renters' Rights Act

Fixed term assured tenancies were abolished on 1 May 2026, and assured tenancies in England are now periodic. As a result, no changes can be made to an assured tenancy in relation to the term or the rent. This agreement is suitable for minor amendments or alterations to the existing tenancy agreement. 

The Tenant Fees Act 2019

Under the Tenant Fees Act 2019 (England), a landlord can require:

• a fee to change the tenancy when requested by the tenant, capped at no more than £50 (inclusive of VAT); or
• where the actual costs of making the change exceed £50, reasonable costs, provided the landlord can supply written evidence, such as invoices or receipts, to justify the amount.
