This Letter of Consent to Decoration should be used where the Tenant wishes to decorate the property and, under the terms of the tenancy agreement, the Landlord’s consent is required.
When To Use This Letter
This letter is intended for cosmetic or decorative changes only, such as:
- Painting walls or ceilings
- Applying wallpaper
- Minor decorative improvements that do not affect the structure of the property
A detailed description or specification of the proposed decorative works should be included in or attached to the letter. This ensures the landlords' consent is clear and unambiguous.
Tenant Fees Act 2019 (England)
Under the Act:
- Landlords cannot charge tenants more than £50 (inclusive of VAT) for agreeing to alter tenancy agreements caught by the Act.
- In limited circumstances, higher fees may be charged if they are reasonable and justifiable, for example to cover professional or administrative costs.
- Landlords must retain written evidence (e.g. invoices or receipts) showing that any higher costs are reasonable and compliant with the Act.
- All fees must comply with permitted payments under the Tenant Fees Act and must be transparent, fair, and documented.
