Photograph Licence
This Photograph Licence is designed for use where a photographer has a portfolio of existing work that can be licensed to third parties, either in part or in full, for use in other projects.
The photographer keeps copyright in, and title to, the photographs. The client is given permission to use selected photographs only for the purposes agreed with the photographer and stated in the agreement.
Licensing existing photographs for agreed uses
This licence can be used where specific photographs from a portfolio are being made available for agreed purposes. Those purposes are set out in the agreement so that both parties understand the permitted use.
The licence can be either:
- exclusive for a stated term; or
- non-exclusive.
Photographer rights, payment and confidentiality
The template includes provisions dealing with copyright and title, use of the photographs, exclusivity, payment, confidentiality, warranties and indemnity.
It also covers moral rights, including the photographer’s right to be identified as the creator of the photographs.
When to use Photographer Terms and Conditions instead
This template is not designed for commissioned photography. Where a photographer is hired for a specific event or photoshoot, the Photographer Terms and Conditions should be used instead.
