This Illustration Licence between an artist / illustrator and a publisher
covers the creation of new illustrations for inclusion in a published work.
The terms of this licence assume that the work will be split into two
phases, that is, two sets of deliverables – roughs and finals – each phase
requiring the approval of the publisher. In each case, provision is made
for an instalment of the final fee to be paid on approval.
It is important to note that the illustrator only licenses the
illustrations to the publisher under this agreement – they are not
assigned. The licence can be exclusive or non-exclusive.
Further provisions in this template address factors such as warranties and
indemnity, obligations, cancellation, confidentiality and the all-important
moral rights, which are asserted by the illustrator – requiring the
publisher to identify the illustrator as the creator of the illustrations.
Optional phrases / clauses are enclosed in square brackets. These should be
read carefully and selected so as to be compatible with one another. Unused
options should be removed from the document.
