Illustration Licence
This Illustration Licence is designed for use between an artist or illustrator and a publisher where new illustrations are being created for inclusion in a published work.
The illustrator licenses the illustrations to the publisher under this agreement. The illustrations are not assigned, and the licence can be either exclusive or non-exclusive.
Roughs, finals and publisher approval
The template assumes that the illustration work will be delivered in two phases:
- roughs; and
- finals.
Each phase requires the publisher’s approval, with provision for an instalment of the final fee to be paid on approval.
Copyright licence and illustrator rights
The agreement covers the illustrator’s and publisher’s obligations, the copyright licence, payment, warranties and indemnity, cancellation, confidentiality and reservation of rights.
It also deals with moral rights, which are asserted by the illustrator. This requires the publisher to identify the illustrator as the creator of the illustrations.
