Heads of Terms for Farm Business Tenancy

These Heads of Terms for Farm Business Tenancy (FBT) are designed to help a landowner and agricultural tenant agree all significant points of principle before the landowner prepares and issues the draft tenancy document (or asks his solicitors to do so).  

The Heads of Terms prompt the parties to record administrative information, such as the their contact details, and to set out what has been agreed in relation to key points such as the length of term, break rights, assignment and underletting, insurance and repair.

It is good practice to attach a plan to the Heads of Terms so that the extent of the holding is clearly defined. If the FBT is to have a term of more than 7 years the plan must be Land Registry compliant.
