Notification of Breach of Trade Credit Terms

The Notification of Breach of Trade Credit Terms Letter is a soft reminder of breaches to credit terms and requests acknowledgement of the balance outstanding.

If the balance represents a number of invoices it is advisable to enclose a statement of the outstanding amounts. Reminder letters and statements (+ versions including the terms of the Commercial Debts Act) are also available.

Before sending this or any other notification of breach of trade credit terms, you should, where the customer is a sole trader, consider whether the Debt Respite Scheme (Breathing Space Moratorium and Mental Health Crisis Moratorium) (England and Wales) Regulations 2020, effective from 4 May 2021 limit or prevent you from doing so (see also our Guidance Note: Debt Recovery and Legal Action).
