This Further Letter to Existing Tenant regarding electrical safety works
(England) is for use by a residential Landlord who has recently had an
electrical installation inspection and test carried out in premises in
England and the report required further investigative or remedial work to
be carried out.
The Electrical Safety Standards in the Private Rented Sector (England)
Regulations 2020 (‘the Act’), imposes duties on private landlords of
residential properties in England to carry out five-year electrical safety
checks. Tenancies granted on or after the 01 July 2020 will be caught by
the Act. Existing tenancies will be caught by the Act from 01 April 2021.
Most tenancies are caught by the regulations, although a number of
tenancies including long leases, tenancies granting a right of occupation
for a term of seven or years or more, social or resident landlords, holiday
lettings, care homes, and licences for lodgers (where the occupier is
sharing accommodation with the landlord) are excluded.
This letter should be printed on the Landlord’s headed paper and sent to
the Tenant with a copy of the written confirmation from the qualified
person confirming that further investigative or remedial work has been
carried out and the electrical safety standards have now been met. This
letter must be sent to the Tenant within 28 days of completion of the
further investigative or remedial work as required by Regulation 3(5)(b) of
the Act.
The Tenant is asked to sign a copy of the Letter and return it to the
Landlord to confirm receipt. The Landlord must remember to send the Tenant
two copies of the Letter and a stamped addressed envelope.
