What is a Form N5?

It is a court form used alongside Form N119 (Particulars of Claim), when a landlord is seeking a court order for possession of a residential property  let on assured shorthold tenancy.  This route is typically used when possession is sought under Section 8 of the Housing Act 1988, citing specific legal grounds. 

When Can I Use This Form?

Before applying to court, a landlord must serve the tenant with a valid Section 8 Notice, specifying the grounds for possession and the date after which court proceedings may begin.

How Do I Complete the Form?

If the claim is solely for rent arrears, you may use the Possession Claim Online service, available here - Possession Claim Online: recover property - GOV.UK.
