Notice To Tenant: Fixing a Date for Possession

This Notice to Tenant Regarding Fixing a Date for Possession can be used by landlords in England where  a postponed possession order has been granted by the court, but the tenant has failed to comply with its terms. The landlord can apply to court to have a date fixed for possession.  Before applying to court the landlord must serve notice on the tenant.

When Should This Template Be Used?

This document should be used to give the tenant notice before applying to the court to fix a date for a possession order where a postponed possession order is in place, and the tenant has breached the terms of that order.

The notice must be served:

  • at least 14 days before making the court application; and 
  • no more than 3 months before the application is made

  • reduce the risk of delays or procedural errors
