Professional Fundraiser Agreement (Individual Donors)

This Professional Fundraiser Agreement (Individual Donors) is for use where a charity makes an arrangement with a “Professional Fundraiser” (as defined by charity law) for the Professional Fundraiser to recruit individuals who make donations to the Charity. This document has been drafted from the viewpoint of the Charity and on the assumption that it will propose the terms of the arrangement to the Professional Fundraiser (not vice versa).

This professional fundraising agreement is accompanied by a detailed set of notes at the beginning of the document. These notes provide guidance about adding to and amending the template agreement, as well as guidance and information on a range of topics relating to arrangements with Professional Fundraisers.

In particular, the notes include guidance on (and examples of) the statement required by charity law to be made by a Professional Fundraiser to donors about its fundraising programme.

The notes also outline how the UK GDPR (UK General Data Protection Regulation) will be applicable to the arrangements. This template has been updated to ensure that it is UK GDPR compliant.

The notes at the beginning of the professional fundraising agreement do not form part of it and they should be removed before it is used.

The particular example of a fundraising programme which is included in the Schedule to this professional fundraising agreement is a “face-to-face” donor recruitment and that example is fully explained in the notes at the beginning of the template.

Where the Fundraiser is to contact potential corporate donors or grant-making trusts seeking donations (rather than having contact with individual potential donors), the charity should instead use the Professional Fundraiser Agreement (Organisations).

Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so as to be compatible with one another. Unused options should be removed from the document.
