Professional Fundraiser Agreement (Organisations)

This Professional Fundraiser Agreement (Organisations) is for use where a charity makes an arrangement with a “Professional Fundraiser” (as defined by charity law) for it to recruit organisations as donors to the Charity.

This professional fundraising agreement is accompanied by a detailed set of notes at the beginning of the document. These notes provide guidance about adding to and amending the template agreement, as well as guidance and information on a range of topics relating to arrangements with Professional Fundraisers. The template also includes a number of examples of the statement required by charity law to be made by a Professional Fundraiser to donors about the fundraising programme carried out by it. These notes do not form part of the professional fundraising agreement and should be removed before it is used.

This template includes two examples of a fundraising business being engaged by a charity where the fundraising business would be regarded under charity law as acting as a “Professional Fundraiser” but other situations might also amount to a charity engaging a “professional fundraiser” under charity law, but if there is doubt in any case, legal advice should be taken. 

This agreement and its accompanying notes include comments about fees and some suggested provisions about fees. Where the fundraiser is to have contact with and seek donations from individual potential donors (rather than potential corporate donors or grant-making trusts), the charity should instead use the Professional Fundraiser Agreement (Individual Donors).
