This Application Form for a Residential Tenancy is for use by a residential
landlord in England to gain information about the proposed tenant (and any
proposed guarantor) which will enable the landlord to consider the
suitability of the proposed tenant (and guarantor) and to obtain
references.
This document is compliant with UK data protection legislation.
The proposed tenant must provide name and address information, as well as
details of their employer, bank and previous landlord.
The proposed tenant (and guarantor) may give an email address and may
(optionally) confirm that this email address can be used by the landlord to
serve notices and other documents on them. The landlord needs such a
confirmation if it wishes to provide the DCLG guide “How to rent: the
checklist for renting in England” by email rather than in hard copy.
The form also requires the proposed tenant to provide their passport or
other relevant documents to enable the landlord to conduct a “right to
rent” check as required under the Immigration Act 2014 in relation to
properties in England.
The proposed tenant ticks boxes and signs the form to authorise the
landlord to carry out right to rent checks and credit checks and to obtain
references. The proposed tenant also acknowledges receipt of the Privacy
Notice for Tenants, Residents and Guarantors. This should be supplied to
the tenant with this Application form. A template Privacy Notice is

If the landlord has concerns about the proposed tenant’s financial
position, it could require the proposed tenant to provide one or more
guarantors.
Under the Tenant Fees Act 2019 (which affects England only), landlords
and/or letting agents are prohibited from charging tenants fees for setting
up new tenancies caught by these acts, which includes the cost of obtaining
references. It will be the landlord’s responsibility to meet these costs.
