Homestay Accommodation (Airbnb-Style) Terms & Conditions
These Homestay Accommodation (Airbnb-Style) Terms and Conditions can be used by the owner-occupier of a residential house or flat who lets rooms to homestay guests such as tourists or foreign exchange students. The Terms and Conditions can be displayed on the Owner’s website or in a brochure. The Booking Form, Confirmation Letter and Terms and Conditions together form a contract between the Owner and the guest.
The Booking Form contains property-specific information such as the name and address of the property, the homestay period and the price. The Terms and Conditions are generic and apply to all bookings. The Booking Confirmation is sent once the booking has been accepted. At this point a contract has been created between the Owner and the guest.
Clause 1 contains definitions and in many cases refers to information contained in the Booking Form. An Inventory should be stored at the property to record the condition of the room and the furniture and contents. If the Owner offers any additional services to guests, such as internet access, breakfast, bicycle hire, etc., these can be referred to in the definition of “Additional Services”. The guest is required to pay for such services on the basis of the Owner’s prevailing tariff. The tariff should be notified to guests on arrival.
Clause 2 deals with the booking procedure and payment of the deposit.
Clause 3 covers payment of the balance of the homestay fees.
Clause 4 is an optional clause requiring payment of a security deposit. The security deposit will be held by the Owner and applied against the cost of remedying any damage caused to the property by the guest. It will be returned to the guest (less any deductions) after their stay.
Clause 5 deals with cancellation. The booking can be cancelled by the guest at any stage but the Owner will retain a specified amount of money depending on when notice of cancellation is received. This ranges from an administration fee (e.g. £100) for early cancellations to 100% of the fees for a last minute cancellation. The booking is also deemed to be cancelled if the guest has not paid the homestay fees (and security deposit, if applicable) by the due date.
Clause 6 sets out the obligations of the Owner during the homestay period. These include provision of hot water and power, bed linen and towels and “on demand” provision of any “Additional Services” such as internet access, breakfast, bicycle hire, etc.
Clause 7 sets out the obligations of the guest during the rental period. These cover careful use of the property, allowing the Owner access for inspections and other practical matters. There are three versions of the “pets” clause: no pets; one well behaved dog; and pets allowed only with the express consent of the owner.
Clause 8 is the termination clause. This allows the Owner to terminate the contract if there has been a substantial breach of any of the guest’s obligations.
Clause 9 contains standard legal interpretation wording.
