Homestay Accommodation Agreement (Airbnb-Style)
This Homestay Accommodation Agreement (Airbnb-Style) should be used where an owner-occupier of a residential property wishes to let a room to a visitor for a short stay. It is suitable for properties near tourist attractions and in areas where a special event is taking place (e.g. a festival or sporting event). The Agreement can also be used where a family is hosting a student from abroad on a foreign exchange trip.
The Agreement sets out the main details at the beginning, being the parties’ names, the address of the property, the duration (licence period), the price (licence fee) and the amount of the security deposit (if any). An Inventory should be completed and attached to the Agreement to record the condition of the room and the furniture and contents.
If the owner offers any additional services to guests, such as internet access, breakfast, bicycle hire, etc., these can be listed in the definition of “Additional Services”. The visitor will be required to pay for such services on the basis of the owner’s prevailing tariff. The tariff should be notified to guests on arrival.
Clause 1 is the grant of the licence.
Clause 2 covers payment of a deposit (which is a percentage of the licence fee) and the balance of the licence fee.
Clause 3 is an optional clause requiring payment of a security deposit. The security deposit will be held by the owner and applied against the cost of remedying any damage caused to the property by the visitor. It will be returned to the visitor (less any deductions) after the stay.
Clause 4 deals with cancellation. The booking can be cancelled by the visitor at any stage but the owner will retain a specified amount of money depending on when notice of cancellation is received. This ranges from an administration fee (e.g. £100) for early cancellations to 100% of the licence fee for a last minute cancellation. The booking is also deemed to be cancelled if the visitor has not paid the licence fee (and security deposit, if applicable) by the due date.
Clause 5 contains the visitor’s covenants. These cover careful use of the property and other practical matters. There are three versions of the “pets” clause: no pets; one well behaved dog; and pets allowed only with the express consent of the owner.
Clause 6 contains the owner’s covenants. These include provision of hot water and power, bed linen and towels and “on demand” provision of any “Additional Services” such as internet access, breakfast, bicycle hire, etc.
Clause 7 is the termination clause. This allows the owner to terminate the agreement if there has been a substantial breach of any of the visitor’s obligations.
Clause 8 contains standard legal interpretation clauses.
