Guidance Notes for Employers: The Agency Workers Regulations 2010
These Guidance Notes for Employers: The Agency Workers Regulations will be of use to businesses that hire temporary staff, and to agencies that supply temporary staff. They summarise the key changes to agency workers’ rights.
Since 1 October 2011, once an agency worker has completed a 12-week qualifying period, they have the right to the same terms and conditions as if they had been recruited directly by the hirer.
Key points covered in these Guidance Notes
The Guidance Notes draw on the Department for Business, Innovation & Skills guidance and the Agency Workers Regulations 2010, and cover:
- what terms and conditions fall within the right to equal treatment
- how the 12-week qualifying period is calculated
- liability issues where the hirer and/or the temporary work agency does not comply with the Regulations
