Extension of Probationary Period Letter

EMP.PP.05

This Extension of Probationary Period Letter is sent by the employer to confirm to the employee that the Probationary Period in the employee’s Contract of Employment is to be extended for a further period.

It states that the employee’s probationary period will be extended and lists the reasons for this extension. The letter also states that employment may be terminated if the employee fails to reach the employer’s required standards.

In deciding for how long the probationary period should be extended, the employer should be aware that ordinary unfair dismissal rights apply after two years’ service. From 1 January 2027, six months’ service is enough where the employment ends on or after that date (or would have, if the statutory minimum notice had been given), even if notice was given before then. Service is counted to the end of the notice period or, if less than the statutory minimum notice is given, to the end of the statutory minimum notice period (one week, for an employee with at least one month’s and less than two years’ service), unless the employee’s conduct (such as gross misconduct) entitled the employer to dismiss without notice. From 1 January 2027, an employee whose service, counted this way, reaches six months (for example, one dismissed at the end of a probationary period of six months or more, including any extension) will usually have those rights.
