Car Repair Terms and Conditions (Dispute Resolution) (B2B)
These Car Repair Terms and Conditions (Dispute Resolution) (B2B) are designed for use by garages or repair shops providing repair services for a variety of vehicles. This document is also suitable for the provision of routine and non-routine maintenance. An optional provision is included in these terms and conditions which covers the provision of courtesy cars.
These terms are not vehicle-specific and so can be applied to repairs for any type of vehicle, including cars, vans, trucks, buses, trailers, or caravans. In each case the garage’s customer must not be acting as a consumer in relation to receipt of the garage’s services, since these terms are designed to be used only in a transaction with someone who is not a “consumer”. A “consumer” is defined in the Consumer Rights Act 2015 as an individual who receives services for his/her personal use and for purposes wholly or mainly outside the purposes of a business of that individual or another.
However, where the garage’s customer is acting as a consumer in relation to the services to be received, we have also provided two accompanying alternative sets of terms for garages to use - the Car Repair Terms and Conditions (VBRA Version) (B2C) where the garage is a member of the Vehicle Builder and Repairer’s Association (VBRA), and the Car Repair Terms and Conditions (B2C) where it is not a member of the VBRA.
These Car Repair Terms and Conditions (Dispute Resolution) (B2B) include limitations / exclusions of the garage’s liability to business customers. These terms also contain dispute resolution as well as investigative and diagnostic work provisions - these additional provisions are similar to those included in the Car Repair Terms & Conditions (VBRA Version) (B2C). Some garages dealing with a business customer might instead to prefer to use a set of terms which do not include such dispute resolution, investigative and diagnostic work provisions, and we have therefore also included an alternative set of terms (also for use for a garage’s business customers) which exclude those provisions - the Car Repair Terms and Conditions (B2B).
Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so as to be compatible with one another. Unused options should be removed from the document.
