Car Repair Terms and Conditions (B2B)
These Car Repair Terms and Conditions (B2B) are designed for use by garages or repair shops providing repair services for a variety of vehicles. This document is also suitable for the provision of routine and non-routine maintenance. An optional provision is included in these terms and conditions which covers the provision of courtesy cars.
These terms are not vehicle-specific and so can be applied to repairs for any type of vehicle, including cars, vans, trucks, buses, trailers, or caravans. In each case the garage’s customer must not be acting as a consumer in relation to receipt of the garage’s services, since these terms are designed to be used only in a transaction with someone who is not a “consumer”. A “consumer” is defined in the Consumer Rights Act 2015 as an individual who receives services for his/her personal use and for purposes wholly or mainly outside the purposes of a business of that individual or another.
However, where the garage’s customer is acting as a consumer in relation to the services to be received, we have also provided an accompanying alternative set of terms for garages to use, the Car Repair Terms and Conditions (B2C).
Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so as to be compatible with one another. Unused options should be removed from the document.
Whilst these terms are suitable for use by general users who are dealing with a business customer – they include limitations/exclusions of the garage’s liability to business customers - a garage might instead wish to contract on terms which not only include that same degree of legal protection but also include some additional terms favouring the garage’s customer. We have therefore also provided the accompanying Car Repair Terms and Conditions (Dispute Resolution) (B2B). Those terms contain include dispute resolution as well as investigative and diagnostic work provisions which are similar to such provisions included in the Car Repair Terms & Conditions (VBRA Version).
