Landlord’s Section 1(4) Initial Notice to Farm Business Tenant

PROP.LAN.19

This Landlord’s Section 1(4) Initial Notice to Farm Business Tenant confirms the Landlord’s intention to create a farm business tenancy under the Agricultural Tenancies Act 1995.

The Landlord and Tenant must exchange Section 1(4) Notices before entering into a farm business tenancy. This is to satisfy the “notice condition” in the 1995 Act. (As an alternative the parties can rely on the “agriculture condition” but using the notice procedure gives the Landlord and Tenant greater certainty.)

There is a separate template Section 1(4) Notice for Tenants: see the Tenant’s FBT Notice.

The Notice satisfies the requirements of Section 1(4) by identifying (by name or a description) the land to be comprised in the tenancy and stating that the Landlord intends the tenancy to be, and remain, a farm business tenancy.

It is good practice to enclose a duplicate Notice for the Tenant to sign and return. This provides the Landlord with evidence that the Notice has been received.

This Landlord’s Section 1(4) Initial Notice to Farm Business Tenant is in open format. Either enter the requisite details in the highlighted fields or adjust the wording to suit your purposes.
