This Letter to Owner: Material Information Requirements is for use by a Residential Estate Agent who has recently been instructed to sell a property. This letter should be printed on the Agency’s headed paper and sent to the Owner as soon as possible and before the property is listed to ensure compliance with the Consumer Protection From Unfair Trading Regulations 2008 in relation to Material Information.
Material information is defined as “information which the average consumer needs, according to the context, to take an informed transactional decision.” Essentially, it includes any details (positive and negative), that might impact a consumers choice to buy a property.
The Consumer Protection from Unfair Trading Regulations 2008 (CPRs) set the standards that Estate Agents must meet to ensure transparency and fairness in their dealings with potential buyers. These Regulations are designed to protect consumers from deceptive practices and ensure they receive all necessary information to make well-informed decisions.

The owner is then asked to sign a copy of the letter and return it to the Agent. The Agent should remember to send the Owner two copies of the documents referred to.
