Guidance on Section 21 Notices under Housing Act 1988

This Guidance on Section 21 Notices looks at the ways a landlord in England can obtain a “no fault” possession of property where the tenant of an assured shorthold tenant has not breached the lease, but the landlord wishes to recover possession.

This Guidance applies to England only. The Renting Homes Wales group contains information on the new procedures to evict contract-holders from a private rented dwelling in Wales. 

The Guidance highlights the relevant sections of the Housing Act 1988 and directs landlords in England to the appropriate forms and letters required for the process. 

Important Notice: The Renters Reform Bill will abolish Section 21 “no fault” evictions and transition all tenancies to periodic tenancies, removing fixed terms. Landlords will only be able to  evict tenants using strengthened Section 8 grounds for possession. We will continue to review and update our documents in line with any legal changes.
