Holiday House Terms and Conditions

These Holiday House Terms and Conditions are designed for owners and operators of furnished holiday homes who let their property to holidaymakers and short-term stays. 

They set out the terms on which the holiday accommodation is booked and occupied, helping the Owner clearly explain the booking arrangements, payment terms, cancellation policy, property rules and responsibilities of the Owner and Guest. 

The Terms and Conditions can be displayed on the Owner's website or provided in a brochure or other booking information. 

How Does This Template Work?

This template should be downloaded with the Holiday Accommodation Booking Form and Holiday Booking Confirmation Letter which form the contract between the Owner and the Guest.  The Owner should ensure that the Guest has an opportunity to see and understand the applicable Terms and Conditions before the booking is made. 

The Terms and Conditions cover the main issues that can arise when letting a holiday property, including:

• Booking and payment arrangements;
• Payment of the holiday rental fee;
• Optional security or damage deposits;
• Cancellation and refunds;
• The Owner's responsibilities;
• The Guest's responsibilities; and
• Property rules and restrictions;

Important: Holiday Letting Compliance

Before letting the Property as holiday accommodation, the Host should make sure that the Property complies with all applicable legal, health and safety and fire safety requirements for holiday accommodation. The Host should also check with the relevant local authority whether any licence, registration, planning permission, property registration or other local authority approval is required for the Property to be used as holiday accommodation. requirements can vary depending on the location and type of accommodation. 

Holiday Let - Not a Main or Principal Residence

This Agreement is specifically for holiday accommodation. The property is provided to the Guest for a temporary holiday stay and must not be used as the Guest's main or principal home.  The agreement makes clear that the parties intend the occupation to be for holiday purposes and not to create an assured tenancy under the Housing Act 1988(as amended). This is particularly important for holiday-let owners who want to distinguish a genuine short-term holiday letting from a residential tenancy. 

This template is for use for a property which is being provided a holiday accommodation for a short term let.
