This Farm Business Tenant’s Notice to Landlord under Section 1(4) confirms the Tenant’s intention to create a farm business tenancy under the Agricultural Tenancies Act 1995.
The Landlord and Tenant must exchange section 1(4) notices before they enter into a farm business tenancy. This is to satisfy the “notice condition” in the 1995 Act. (As an alternative the parties can rely on the “agriculture condition” but using the notice procedure gives the Landlord and Tenant greater certainty.)

The Notice satisfies the requirements of Section 1(4) by identifying (by name or a description) the land to be comprised in the tenancy and stating that the Tenant intends the tenancy to be, and remain, a farm business tenancy.
It is good practice to enclose a duplicate Notice for the Landlord to sign and return. This provides the Tenant with evidence that the Notice has been received.
