Clause 1 contains definitions.
The Fishing Rights are defined as the right to fish in a particular body of water using rod and line. There is an optional right to carry fish away.
The Licensor can use the “Permitted Days” and “Permitted Hours” definitions to specify the times at which the Licensee may exercise the Fishing Rights.
The definitions of Parking Area and Water make optional reference to a plan. It is recommended that a plan is included so that the extent of the land being used is clear.
Clause 2 contains the grant of the Licence and the right to use the Parking Area.
Clause 3 contains the Licensee’s covenants. These cover payment of the Licence Fee, exercising the Fishing Rights in accordance with laws and byelaws, and a requirement for the Licensee to maintain public liability insurance.
Clause 4 contains some standard clauses including a requirement for notices to be served in accordance with section 196 of the Law of Property Act 1925. This means that notices should be delivered by hand or sent by recorded or special delivery post. If the notice is sent by recorded or special delivery post, service is deemed to occur at the time at which the letter would “in the ordinary course” be delivered.
