This Section 27(2) Notice to End a Commercial Lease is a formal notice for a tenant to serve on its landlord if the tenant does not wish to renew a lease that either is about to expire or has expired.
A Section 27(2) Notice is only required if the tenant has security of tenure, i.e. the statutory right of a business tenant to remain in occupation of the premises when a lease expires. This right may have been excluded when the lease was granted or may have been lost because, for example, the tenant has vacated the premises before the end of the term. If the lease is not secure, no notice needs to be served and the tenant should simply vacate on the last day of the term of the lease.
This Notice must be given to the Landlord not less than 3 months before the date on which the tenant wishes the tenancy to end. Serving this Notice means that the lease will not continue beyond the date specified in the notice (as it would otherwise do under the Landlord and Tenant Act 1954).
If there is more than 3 months to go before the end of the term the Tenant should instead serve a Section 27(1) Notice to bring the lease to an end on the contractual expiry date.
