Dealing with Technical Requirements not Met by Suppliers

Where the manufacturer or supplier has not complied with the requirements of any relevant EU product directives the employer must ensure that any shortfall in standards is made good. He may do this by taking the necessary steps himself or by getting the manufacturer or supplier to take those steps.

The employer must also ensure that specific technical requirements which are relevant to an item of work equipment are met where:

  • the work equipment is not covered by any EU product directives; or
  • the EU product directive(s) that apply to the work equipment cover none, or only some, of the specific technical requirements.
