Discrimination: Introduction

The recruitment and selection of applicants for a job is largely at your discretion, except if an applicant can prove that the choice was made on grounds of sex, marital status, sexual orientation, gender reassignment, gender, belief, race, trade union membership or non-membership, a spent criminal conviction, disability or age.

In such cases, the unsuccessful applicant may claim to have been discriminated against on one of these grounds and seek compensation for such discrimination at an Employment Tribunal.

Beyond the specific minimum legal requirements addressed in this section, you should make public your commitment to equal opportunity / equality and diversity, whether racial, sexual or otherwise, by developing and publishing a policy on the issue.
