These Cookie Law Guidance Notes address the important privacy requirements imposed on website owners operating websites within the EU and provide practical guidance for compliance.

In force from 26th May 2011 and enforced by the Information Commissioner’s Office from 26th May 2012, the Privacy and Electronic Communications (EC Directive) Regulations 2003, as amended by the Privacy and Electronic Communications (EC Directive) (Amendment) Regulations 2011 require websites operating within the EU to obtain consent for the placing of all but strictly essential cookies on users’ computers and devices.

These Guidance Notes have since been updated, taking into account common practices which have become established in the years since the Regulations came into force. Whereas many were initially concerned that complex technical arrangements would be necessary, many of which stood to jeopardise carefully-designed user experiences, the reality has proven to be considerably simpler. Providing clear information to users is unquestionably the priority.
