Revocation of Power of Attorney

EX02.03.11

A power of attorney may be revoked by the grantor of the power of attorney (POA) provided that the POA does not state that it is irrevocable.

A revocation of a POA should normally be effected by means of a document in the form of a deed executed (signed) by the grantor of the POA.

This Revocation of Power of Attorney template is in the form of a deed, and it is designed to be used to revoke any revocable (ordinary or special) POA which has been granted by an individual. If the POA was granted by a company, the accompanying Revocation of Corporate Power of Attorney should instead be used.

This Revocation of Power of Attorney is not for use in connection with any Lasting Power of Attorney (LPA).

If a POA is not revoked, it will come to an end in accordance with its duration clause (if it includes such a clause), or automatically if and when the grantor dies. Similarly, it may come to an end when the grantor loses mental capacity but note that the law is uncertain as to whether, when and how loss of mental capacity brings the power to an end.

You should consider whether this template, as drafted or with any adaptation, meets your needs before using it.

This Revocation of Power of Attorney template is in open format. either enter the requisite details in the highlighted fields or adjust the wording to suit your purposes.
