Recovering Training Grants
You may well spend a considerable sum on training an employee who subsequently leaves you. You may therefore wish to come to an agreement with the employee under which you can recover some or all of the expenditure if the employee resigns within a certain time thereafter. Such an agreement is enforceable and should be upheld by a court or employment tribunal provided the terms of the agreement are not unfair.
The agreement could either form part of the employment contract when the employee joins or alternatively may be specifically concluded when arranging the training or at the conclusion of that training.
